Terms of Service

These Terms of Service govern your use of Pellō, operated by Pello LLC, a Colorado limited liability company. By creating an account or using the App, you agree to these Terms in full.

1. Eligibility

You must be at least 18 years of age to use Pellō. Pellō is intended for use by residents of the United States.

2. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. How Pellō Works

When you create a card-backed challenge, your payment method is saved through Stripe and you authorize one conditional charge of the amount you chose; nothing is held or charged at that time. (Some earlier challenges used a temporary authorization hold instead; those follow the same payment process.) In Solo, one-way, and head-to-head challenges, a final result of Done means no charge and a final result of Missed triggers the authorized charge. Team challenges use separate member results by default. If the creator explicitly chooses Ride or Die, one member's Missed result triggers every member's authorized charge, including members whose own proof counted. Where the destination is a person (a paid Ref, including a Team Ref, or the person owed money in head-to-head), that recipient must finish Stripe payout verification before the paid challenge can become active. Stripe routes the full charge to that person's Stripe connected-account balance for a seven-day review window. At the end of the review, Stripe routes Pellō's disclosed 15% fee to Pellō and sends the recipient's 85% share to their bank. Keeping the charge together during review allows a refund or dispute to reverse one Stripe transfer before the bank payout begins. If Stripe unexpectedly restricts that recipient after activation, Pellō does not charge the card until Stripe can safely route the charge, then retries the authorized charge automatically. The recipient's share does not sit in a Pellō bank account or Pellō wallet. In head-to-head, each player chooses a payment rail for that player's own side. When one result is Missed and the other is Done, that side pays the person whose result is Done. When both results are Missed, each saved-card side is charged and routed to the other player under the same disclosed split; a direct-Venmo side has no Done recipient, so no direct payment is due for that side. A current card-backed organization choice records the selected cause but does not send money to that organization; Pellō retains that charge until an organization payment rail is offered. Other Pellō-destination card charges are also retained by Pellō as disclosed in the final terms. When direct Venmo is available and selected, the full amount is paid person-to-person and Pellō charges no fee. Pellō is a personal accountability service, not gambling, betting, or a game of chance: the amount is your own money committed to your own goal.

4. Referee Terms

You may name a Ref you know or, where the option is offered, ask Pellō to notify eligible volunteer Refs. Pellō does not vet or guarantee the conduct of any Ref; the first eligible volunteer to accept may take an open request. Your Ref must accept the role before a challenge becomes active. Your Ref's decision regarding proof approval or rejection is ordinarily final. An appeal path exists: you may request an excusal through the app, which your Ref can grant or deny, and you may contact support about a decision you believe was made in bad faith; Pellō may, at its discretion, review and remedy such cases. By accepting the role of Ref, a user agrees to review submitted proof in good faith and provide a written reason for any rejection.

5. Payments

All card charges, connected-account balances, and bank payouts are processed by Stripe. You authorize Pellō to save your payment method and initiate the single conditional charge described above. Pellō may instruct Stripe to pause or schedule a connected-account bank payout during the disclosed review window, but the recipient's share remains in Stripe. Pellō does not store your full payment card information.

6. Prohibited Conduct

You agree not to create challenges or submit proof in bad faith, collude with your Referee to fraudulently approve incomplete challenges, use the App for any unlawful purpose, attempt to reverse or chargeback legitimate captures, or impersonate another person.

7. Disclaimer of Warranties

Pellō is provided as-is without warranties of any kind. We are not responsible for the conduct of any user, including Refs.

8. Limitation of Liability

Pellō shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount of your most recent challenge.

9. Governing Law

These Terms are governed by the laws of the State of Colorado.

10. Text Messages (SMS)

If you opt in to text notifications, Pellō sends recurring automated SMS alerts about your own account and challenges, such as Ref requests, proof reviews, deadline reminders, results, and payment confirmations. Opt-in is off by default and is controlled in your Profile. Message frequency varies with your activity. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. No mobile information is shared with or sold to third parties or affiliates for marketing. See our Text Notifications page and Privacy Policy for details.

11. Changes

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance.
